Safe Body Art Act Informed Consent Form Requirements 

A body art facility and body art practitioners shall use an Informed Consent form, which includes consent to the procedure, post procedure instructions, and a medical questionnaire. Prior to the performance of body art, the client shall read, complete, and sign an Informed Consent form (H&SC §119303). 

The Informed Consent Form shall include all of the following: 

1. A description of the procedure. 

2. A description of what the client should expect following the procedure, including suggested care and any medical complications that may occur due to the procedure. 

3. A statement on the permanent nature of body art. 

4. Post procedure instructions on the care of the procedure site that include 

 Information on the care of the procedure site 

 Restrictions on physical activities such as bathing, recreational water activities, gardening, or contact with animals, and the duration of the restrictions 

 Signs and symptoms of infection, including, but not limited to, redness, swelling, tenderness of the procedure site, red streaks going from the procedure site toward the heart, elevated temperature, or purulent drainage from the procedure site 

 Signs and symptoms that indicate the need to seek medical care 

5. A questionnaire that includes the following information: 

 Whether the client may be pregnant 

 Whether the client has a history of herpes infection at the proposed procedure site, diabetes, allergic reactions to latex or antibiotics, hemophilia or other bleeding disorder, or cardiac valve disease 

 Whether the client has a history of medication use or is currently using medication, including being prescribed antibiotics prior to dental or surgical procedures 

 Other risk factors for bloodborne pathogen exposure 

 A signature of the client 

The Informed Consent forms (including consent, post procedure instructions, and medical questionnaire) must be maintained in a secure location on-site and available for review during permit inspections for a period of two years. After two years from performing the body art procedure, the body art facility shall shred any confidential medical information from the client. 

The body art facility shall maintain the privacy of the information and shall not sell, share, or transfer the information. A body art facility shall comply with all state and federal laws with respect to the protection of a client’s personally identifiable information, including, but not limited to, medical information, and shall be subject to existing penalties for violation of applicable laws.

안전한 문신 관련 정보 제공 동의서 요건

문신업소 및 문신사는 의료 설문지를 포함하는 시술 동의서, 시술 후 주의사항 안내 및 사전 동의서를 사용해야 합니다.

고객은 문신 시술 전에 사전 동의서를 읽고 작성한 후 서명해야 합니다 (미국 보건복지부 §119303 조항). 

사전 동의서에는 다음 사항이 모두 포함되어야 합니다.

1. 시술 절차에 대한 설명.

2. 시술 후 예상되는 사항, 권장 관리 방법 및 시술로 인해 발생할 수 있는 의학적 합병증에 대한 설명.

3. 문신 영구성에 대한 설명. (미용문신 서화문신 구분 없이 동일) 

4. 시술 부위 관리에 대한 시술 후 지침 (다음 사항 포함):

 시술 부위 관리 정보

 목욕, 물놀이, 정원 가꾸기, 동물 접촉 등과 같은 신체 활동 제한 사항 및 제한 기간

 감염 징후 및 증상(시술 부위의 발적, 부기, 압통, 시술 부위에서 심장 쪽으로 이어지는 붉은 줄무늬, 고열, 시술 부위에서 나오는 화농성 분비물 등)

 의료 처치가 필요한 징후 및 증상

5. 다음 정보를 포함하는 설문지:

 임신 가능성

 시술 예정 부위의 헤르페스 감염 이력, 당뇨병, 라텍스 또는 항생제 알레르기 반응, 혈우병 또는 기타 출혈 장애, 심장 판막 질환 유무

 과거 약물 복용 이력 또는 현재 약물 복용 여부 (치과 또는 외과 시술 전 항생제 처방 포함)

 기타 혈액 매개 병원체 노출 위험 요인

 환자 서명

사전 동의서(동의서, 시술 후 주의사항, 의료 설문지 포함)는 현장 내 안전한 장소에 보관하고 허가 검사 시 검토할 수 있도록 2년간 비치해야 합니다. 문신 시술 후 2년이 지나면 문신 시술 시설은 고객의 모든 기밀 및 의료 정보를 파기해야 합니다.

문신 시술 시설은 정보의 개인정보 보호를 유지해야 하며, 해당 정보를 판매, 공유 또는 양도해서는 안 됩니다. 문신 시술 시설은 고객의 개인 식별 정보(의료 정보 포함) 보호와 관련하여 모든 주 및 연방 법률을 준수해야 하며, 관련 법률 위반 시 기존 처벌을 받게 됩니다.
